1 WEBSITE USE OF TERMS & CONDITIONS

Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern SoftWurkz's relationship with you in relation to this website.

The term "SoftWurkz" or "us" or "we" refers to the owner of the website whose office is 7, Angus Close, Kimberley, Nottingham, NG16 2GX. The term "you" refers to the user or viewer of our website.

The use of this website is subject to the following terms of use:

1.1 The content of the pages of this website is for your general information and use only. It is subject to change without notice.

1.2 Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

2 PAYMENT TERMS & CONDITIONS

2.1 Payment of the license fee for either SoftWurkz Sli£k Gold or Silver products can be made by any method shown on the Website at the time of ordering. SoftWurkz Ltd may from time to time add or change payment methods primarily for the benefit of their customers.

2.2 License fees are inclusive of VAT where applicable. Where appropriate VAT is charged at the rate prevailing at the relevant tax point and will be shown separately on invoices and statements.

2.3 License fees can be paid annually in advance or by monthly payments.

2.4 Thirty days prior notice of any increase in license fees will be given in writing.

2.5 We will automatically inform you when your licence needs to be renewed and a new 25 digit ident code will given to you which you will need to renew your licence. Go to the buy facility on the SoftWurkz Ltd website and follow the instructions. Upon confirmation of cleared funds from you a new 25 digit pin number will be issued to you to enable you to continue using the software.

2.6 The license fee will be the then current fee as shown on the SoftWurkz Ltd website.

2.7 Customers are required to provide SofWurkz Ltd with complete and accurate billing and contact information including, legal company name, street address, e-mail address, and name and telephone number of an authorised billing contact. Any changes to these details must be notified to SoftWurkz Ltd within thirty days of any such change. If the contact information supplied to SoftWurkz Ltd is found to be false or fraudulent, SoftWurkz Ltd may terminate your contract.

2.8 If you believe your bill is incorrect, you must contact SoftWurkz Ltd in writing within thirty days of the invoice date of the invoice containing the amount in question to be eligible to receive an adjustment or credit.

2.9 In consideration of your payment SoftWurkz Ltd grant you a non-exclusive right for the period of one year to use SoftWurkz Sli£k Bookkeeping Silver or Gold products in accordance with these Terms. This licence is personal to you and is for your benefit only. You will not sub-license, assign, rent, lease, transfer, resell, distribute or otherwise commercially exploit or make available to any third party or make copies of SoftWurkz Sli£k Bookkeeping Silver or Gold.

3 YOUR OBLIGATIONS

3.1 You are responsible and shall abide by all applicable laws and regulations in connection with your use of SoftWurkz Sli£k Bookkeeping Silver or Gold products including those related to data privacy, communications and the transmission of technical or personal data.

3.2 You are required to notify SoftWurkz immediately of any unauthorised use of any SoftWurkz products or any other known or suspected breach of security.

3.3 You are required to notify SoftWurkz immediately and use reasonable efforts to stop immediately any copying or distribution of any SoftWurkz products.

4 CANCELLATION

4.1 You have the right to cancel the Contract at any time up to the end of fourteen working days (a working day is any day other than weekends and bank or other public holidays) from the date that SoftWurkz Ltd receives confirmation of cleared funds from you. Any contract cancellation request must given in writing to SoftWurkz Ltd by hand or post, fax or email, at the address, fax number or email address shown on the SoftWurkz Ltd website. In the above circumstances you will receive a full refund of the amount paid by you in accordance with the SoftWurkz Ltd refunds policy as detailed below.

4.2 In the event that any product supplied by SoftWurkz Ltd, is found to be defective any refund will be made in accordance with our refunds policy as detailed below.

4.3 Save as set out in 3.1 & 3.2 should you cancel your contract before the end of the relevant licence year and you have not paid the full amount of the annual licence the outstanding balance of the licence shall become immediately due and payable and you shall make payment thereof within fourteen days of your cancellation.

5 REFUNDS POLICY

5.1 Refunds are at our sole discretion. If you wish to obtain a refund because you have cancelled a Contract between you and SoftWurkz Ltd or because you claim that a SoftWurkz product is defective, we will notify you of any refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. Any refund to you will be processed as soon as possible and, in any case, within thirty days of the day on which SoftWurkz Ltd received notice from you that you wished to obtain a refund.

5.2 If you wish to obtain a refund because of a SoftWurkz product being defective you will be refunded in full, provided that SoftWurkz Ltd are satisfied that the defect is genuine and that it is not capable of rectification within a reasonable period of time.

6 INFORMATION AND DATA

6.1 SoftWurkz Ltd does not own any data, information or material that you submit to SoftWurkz Ltd in the course of your contract with SoftWurkz Ltd ("Customer Data"). You have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all Customer Data, and SoftWurkz Ltd shall not be responsible or liable for the deletion, correction, destruction, damage, loss or failure to store any Customer Data. We reserve the right to withhold, remove and/or discard Customer Data without notice for any breach by you of these Terms including, without limitation, your non-payment.
